Terms and conditions


1. You (the customer) are entering into an agreement with Abracadabra Swim School or one of its franchises. Hereafter referred to as “we”, “us”. Upon your payment to us, you and we agree to the following terms and conditions of this agreement.

1.1 Our obligations to you:

On receipt of payment, we promise to provide swimming lessons for the agreed upon time at the agreed upon times and dates. These lessons will be provided by a qualified swimming instructor, who will be DBS checked. We will do our best to ensure consistency of instructor, but cannot guarantee a specific


1.2 At the end of the agreed period, a time slot, where available, will be held for you until a set deadline. This will give you priority access to that space until the deadline. The time of your class may be subject to change once the agreed period has ended.

1.3 There may be circumstances in which we recommend that the swimmer change groups during the agreed period. Reasons may include, but are not limited to: change in ability (such as finding their group too easy or hard), or aging out of a parent and child group. This change will be optional and you can keep your space until you choose to change it. Once you have agreed upon the change, you forfeit your right to the initial place in the class, in favour of the new class.


2. In exceptional circumstances, we may need to cancel your lessons. This is rare, but reasons may include, but are not limited to: the pool, or facilities being deemed as unsafe, staff absence, or sudden illness, fouling of the pool, or an emergency.

2.1. In the event of a class needing to be cancelled, credits in equal amount to the number of lessons cancelled will be issued. In the event that we cannot provide the lessons where these credits may be used, a refund for the value of the missed lessons will be provided.

3. In the event of absence, as long as the lesson is made available (ie, staff and pool are available for the lesson) your payment for that session may be lost. At our discretion and subject to availability, we may issue a catch up lesson within 7 days. This is limited to a maximum of 1 lesson per term. In the event of a long term injury or medical condition, see 3.1.

3.1 In the event of a long term medical condition or injury that results in the swimmer being unable to attend 3 or more consecutive lessons, we can, at our discretion offer a medical credit. This will require evidence of the condition or injury, such as a letter from a doctor.

3.2 Once payment has been received for a block of lessons, the client has committed to that time period. This cannot be cancelled once payment has been made, regardless of attendance or absence for any reason. The only situations in which we would be obligated to provide a refund would be (a) in the unlikely instance that we are no longer able to provide the agreed upon lessons, or credited lessons where issued. Or (b) if you have a legal right to a refund. Refunds will not be issued for lessons already received, even if you were absent.

3.3 All lessons are to be paid for in advance. If you attend lessons without having paid we reserve the right to refuse your entry.

4. If you want to change your lesson.
If you would prefer a different time or day for your lessons, providing that we have a suitable class with space, we will do our best to accommodate your needs. Please get in touch with us and we can let you know what availability we have. Please be aware that if you give up your old space in favour of a new one, your old space may be filled and you may not have the opportunity to change your mind once the decision to change has been made.

5. All users of the pool, pool building and premises, including swimmers, their supervising adults, families and any other persons attending with them will be expected to follow the swim school's code of conduct. In extreme cases, breach of the code of conduct can result in a ban from the school. No refund will be issued in this instance.

6. A supervising adult will need to remain within the pool building at all times. We encourage parents and guardians to watch the lessons and see the progress that the swimmers are making. We are not a childcare provider.

7. Your statutory rights are unaffected.

Code of conduct

While in the pool building, all adults and children are expected to abide by pool rules, including:

  • No running,
  • No food or drink (other than plastic bottles of water)
  • No outdoor footwear (unless wearing overshoe covers provided)

Parents and guardians should closely supervise their children while on school grounds. Children are not permitted to use play equipment on school grounds, by request of the school. Swimmers and families should not be on the school field at any point.

Please be aware that cars are not allowed to enter before 3:40pm on a school day. This is to ensure the safety of school children, who may still be leaving through the car park. Drivers, please ensure that you take the utmost care when in the car park and do not exceed 5mph.

We ask that at all times while in the pool building and not in lessons, children should wait quietly with their parents and not interfere with or distract the teachers or swimmers. Tablets and phones can be great for keeping children occupied, but please have them set to silent.

We expect all parents to be respectful of the facilities and staff. Any litter should be put in a bin (there's one at each end of the pool building, outside). Please dispose of any nappies, including swim nappies in the large bins by the front gate.

If a parent or guardian leaves poolside during a lesson, they must first inform a member of staff, and must have their mobile to hand in case of emergencies. They must not leave school grounds.

Parents are responsible for the personal hygiene of their children. Please encourage children to use the toilet prior to the lesson starting. Children who have had sickness or diarrhoea in the last 24 hours should not be attending. Any child with a contagious health condition, beyond a cold, should not attend. Chicken pox must be scabbed over before entry. If children are covered in mud from playing before the lesson, entry may be refused.

Plasters are not to be worn in the water, as they rarely stay on when wet. If swimmers have an injury that's still bleeding, they shouldn't be in the water, if it's not bleeding, they no longer require a plaster.

Please no earrings to be worn in the pool, they get lost and can present a hazard to bathers and the workings of the pool. Loose jewellery should also not be worn in the water as it may cause injury.

Abuse of staff will not be tolerated and will lead to an immediate ban with no refund. Repeated breaches of this code of conduct may also result in a ban with no refund.

Photography will not be allowed, barring special circumstances. Anyone wishing to take photographs must first ask the permission of the Safeguarding Officer (Benjamin Jones) and must only involve their own children, unless parental consent has been given.

There may be times that an instructor might use videos of a swimmer to assist with their learning, but the teacher will ask for parental consent prior to doing this. We may also look to take photographs for promotional purposes, but, again only with parental consent.
